PART 1 st: GENERAL CONDITIONS OF RENT FACILITIES

ARTICLE 1: RESERVATION

and the tenant whose contact details are provided on page 1 of this document.

The contract is a tourist rental contract. The short duration of the contract constitutes an essential condition without which the contract would not have been concluded. The tenant cannot establish his principal residence in the rented building.

The tenant undertakes to ensure the tranquility and respect of local residents.

ARTICLE 2 : TERMS
The hiring is effective by the payment of a deposit of 30% of the price of the stay; to be paid to bank account number BE63 0637 2828 3008 within 8 days - at the latest - of receipt of this document.

The overall rental price includes the stay with the following supplements included: charges, tourist taxes.
However, it does not include the rental guarantee and any other supplements.

The rental guarantee, in the amount of €250.00 (two hundred and fifty euros), will be deposited 30 days before arrival at bank account number BE630637 2828 3008.
The guarantee will be returned within 8 days of departure if there is no damage to the accommodation, annex buildings and surroundings. The owner reserves the right to refuse access to the gîte if the guarantee is not paid.

The lessor chose stripe.com to secure online payments by credit card. The validity of the customer's payment card is verified by stripe.com.
There may be a refusal of the payment card for several reasons: stolen card, blocked card, ceiling reached, input error...
In the event of a problem, the customer must approach his bank on the one hand, the establishment on the other hand to confirm his reservation and his method of payment.

ARTICLE 3 : PAYMENT OF THE BALANCE
The remaining balance, corresponding to 70% of the price of the stay, is to be paid no later than 30 days before arrival to bank account number BE63 0637 2828 3008.
In the event of multiple tenants, the debts and receivables are joint and indivisible between them.

In the event of cancellation or no-show of the client, the lessor will debit the client's credit card in accordance with the cancellation conditions (cf. article 4).

ARTICLE 4 : CANCELLATION BY THE TENANT
Cancellation must be communicated by registered letter or email addressed to the owner.

The following costs are taken into account:
-
from the reservation date to 30 days before departure: 30% of the price of the stay;
-
from 29 days before departure to the day of departure included or in the event of a no-show at the place of stay: 100% of the price of the stay.

In the event of force majeure (or act of the prince) for one or the other party, the rental contract will be suspended and postponed to a later date to be agreed between the parties.

If an agreement could not be found within a period of 18 months, the amounts paid will be fully refunded to the tenant.

The aforementioned costs do not apply if the tenant or the owner finds a replacement for the same period.

SECTION 5 :INSURANCE
- Fire insurance :
The tenant declares to be covered for such risks by his personal fire insurance (holiday insurance). Otherwise, the tenant agrees to sign a contract covering this risk.

- Family Civil Liability Insurance (private life):
The tenant declares to be covered by a family RC.

The owner declines all responsibility for damage, loss or theft of personal property brought by the tenant or the persons accompanying him.

ARTICLE 6 : SHORTENING THE STAY
A shortening of the stay due to the tenant does not entitle you to a refund.

ARTICLE 7 : PETS
When admitted, pets accompanying the tenant must be reported to the lessor.
A possible supplement may apply.

ARTICLE 8 : INVENTORY
It is agreed that an inventory of the rented premises, furniture, equipment and utensils, will take place upon entry into possession and upon departure of the tenant. Any loss or damage as well as the non-respect of the cleanliness of the premises will give right to compensation.

ARTICLE 9 : COMPLAINTS
Any complaint must be sent to the lessor by registered letter within 8 days after the end of the stay. Supporting documents must be attached.


2nd PART: GENERAL CONDITIONS OF SALE ONLINE VIA CRO

ARTICLE 1   : OBJECT
These general conditions apply to all online reservations made with our establishment, using the Regional Marketing Tool (ORC).
The customer acknowledges having read and accepted these general conditions. No reservation is possible without the customer having indicated his agreement with them. The customer has the option of saving and printing these general conditions.

ARTICLE 2 : OFFERS
All of our advertisements, web pages or offers are developed in good faith and based on available data. Maps, photos and illustrations are presented for information purposes and are not contractual. They can be modified before the finalization of the reservation.The customer authorizes us to correct any obvious material errors in the information that we communicate to him.

ARTICLE 3 : PRICE
The prices displayed at the time of booking constitute the total price of the service sold, including taxes, fees and other charges. Any supplements are clearly indicated before the reservation is made for the service.

ARTICLE 4 : RESERVATION
The customer chooses the services presented on the regional marketing tool. He acknowledges having read the nature, destination and booking methods of the services available on the booking tool and having requested and obtained the necessary and/or additional information to make his booking in full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability to his needs, so that our responsibility cannot be engaged in this regard.The reservation is deemed accepted by the customer at the end of the reservation process.

ARTICLE 5 : RESERVATION PROCESS
Reservations made by the customer are made via the dematerialized reservation form accessible online on the reservation tool. The reservation is deemed to have been made upon receipt of the reservation voucher. The customer agrees, prior to any reservation, to complete all the information necessary for the reservation. The customer certifies the veracity and accuracy of the information provided.Once the final choice of the services to be reserved has been made, the reservation procedure includes the following steps until validation: entry of the bank card in the event of a guarantee or prepayment request, consultation and acceptance of the general conditions of sale relating to the service(s) and, finally, the validation of the reservation by the customer.

ARTICLE 6 : ACKNOWLEDGMENT OF RECEIPT OF THE RESERVATION
The reservation tool acknowledges receipt of the customer's reservation and confirms it by sending an email without delay.The confirmation of the reservation by e-mail summarizes the contract offer, the services reserved, the prices, the conditions of sale relating to the selected rate, accepted by the customer, the date of reservation made as well as the address of the establishment. to which the customer can lodge his complaints.

ARTICLE 7 : RIGHT OF WITHDRAWAL
It is recalled that, in accordance with article VI.53 of the Belgian Economic Law Code, if the contract provides for a specific date or period of performance, the customer does not have the right to withdraw in the event of a reservation:
- accommodation other than for residential purposes (e.g. holiday accommodation),
- transportation,
- car rental,
- catering and services related to leisure activities.

ARTICLE 8 : RESPECT FOR PRIVACY
We collect your data in accordance with the General Data Protection Regulation (2016/679) (""GDPR"").

The personal data you provide us with is necessary for the processing of your reservation and is essential for the management and provision of the services (article 6.1.b of the aforementioned Regulations). For these purposes, your data may thus be transferred to our partners, including in particular Elloha.com which manages the booking tool, online payment service providers, service providers established in third countries.In particular when paying online, the customer's bank details must be transmitted by the payment service provider to the bank of the establishment, for the execution of the reservation contract. We only use partners who guarantee a level of protection in accordance with the principles enshrined in the GDPR.

With your consent, your data may also be used by us to send you our promotional or commercial offers, by e-mail or post.

We keep your data for a period of 3 years after the last contact (email, reservation, etc.).

As the person whose data is collected, you have a right of access, rectification, erasure of your data, as well as a right of opposition to the collection of your data. These rights can be exercised by sending us an email, mentioning your surname, first name and address as well as the subject of your correspondence.

Your complaints relating to the collection and processing of your personal data can be addressed to the competent supervisory authority.
